À peine neuf mois après l'adoption de la loi dite Valter (Loi n°2015-1179 ), ayant consacré le principe de gratuité pour les informations du secteur public, la loi n° 2016-1321 du 7 octobre 2016 pour une République numérique modifie substantiellement le Code des relations entre le public et l'administration (CRPA). Elle constitue le deuxième acte d'une pièce qui s'inscrit dans une démarche législative globale en faveur de l'ouverture des données publiques. Ce mouvement, que certains dénomment « open data », plaide pour la circulation des données générées par le secteur public.

L'open data (ou ouverture des données publiques) est désormais un passage obligé pour les collectivités locales. Avec comme objectifs la transparence et l'efficacité de l'action publique, l'innovation économique et sociale, la transformation numérique de l'administration publique se précise avec la publication de nouvelles lois. Présentée comme un texte de transposition stricte de la directive n° 2003/98/CE du 17 novembre 2003 concernant la réutilisation des informations du secteur public, la loi n° 2015-1179 du 28 décembre 2015 relative à la gratuité et aux modalités de la réutilisation des informations du secteur public est un texte tout en nuance. Elle supprime l'exception en faveur des établissements culturels et d'enseignement et de recherche, limite la durée d'effectivité des accords d'exclusivité et renforce la transparence. Mais le projet ambitieux de libéralisation des informations publiques reste inachevé. L'open data n'est pas encore ancré dans la loi.

Il y a maintenant 35 ans, le Parlement reconnaissait à toute personne le droit d'obtenir communication des documents de l'administration. Il ouvrait ainsi aux citoyens, en rupture avec la confidentialité caractéristique de la culture administrative française, la possibilité d'analyser et de comprendre les décisions publiques et de les contester.
À l'ère du numérique, l'accès aux informations produites et recueillies par l'administration ainsi que la possibilité de les réutiliser prennent une dimension entièrement nouvelle, dont les enjeux sont à la fois stratégiques, démocratiques et économiques.La mission commune d'information a souhaité, d'une part, s'assurer de l'effectivité du droit formulé en 1978 et, d'autre part, évaluer la pertinence et l'efficacité des politiques engagées depuis quelques années par les pouvoirs publics en matière de diffusion de l'information publique et, plus récemment, d'open data, c'est-à-dire d'ouverture des données publiques.

Le thème du rapport public du Conseil d'État - la participation des citoyens à la prise de décision publique - porte cette année sur une question transversale, portant sur le renouvellement des procédures et intéressant l'ensemble de l'activité de l'administration. Par ses analyses et ses propositions, l'étude du Conseil d'État dessine les traits d'une nouvelle figure de l'administration que le Conseil d'État appelle de ses vœux, une administration qualifiée de " délibérative " parce qu'elle cherche à développer, au-delà des consultations formelles qui gagneraient à être allégées, de nouvelles procédures caractérisées par l'innovation, la transparence, l'ouverture, le débat public et le compte rendu, que ce rapport présente en détail.
